Terms & Conditions
1. Booking and Confirmation
1.1 Booking Process
To book a safari with Lusso Safari Expeditions, please visit our website or contact us via email or phone. All bookings are subject to availability and confirmed once a deposit has been received.
1.2 Deposit and Full Payment
– A deposit of 50% of the total safari cost is required to confirm the booking.
– The remaining balance is due 120 days before the departure date. If the booking is made less than 120 days before the departure, the full payment is required at the time of booking.
-For activities like Gorilla Trekking and Chimp Trekking, 100% payment is required as booking fee for the activity since UWA requires full amount to secure the permits in time.
1.3 Booking Confirmation
Once payment has been received, a confirmation email will be sent, along with the details of your safari itinerary and any other relevant information.
2. Payments
2.1 Accepted Payment Methods
We accept payments via:
– Bank transfer for both international and Local clients
– Credit card (Visa, MasterCard, American Express)
2.2 Currency
Payments must be made in USD or other agreed currencies. The exchange rate applied will be determined at the time of booking.
2.3 Bank Fees
Any transaction fees associated with payments are the responsibility of the client.
3. Cancellations and Refunds
3.1 Cancellation by Client
– This will be determined by the mutual agreement between the company and the client since most activities and accommodations are to be paid prior to arrival.
– Gorillas and Chimpanzee permits are NON-REFUNDABLE
3.2 No-Show and Early Departure
Clients who do not show up for their scheduled safari or leave the tour early are not entitled to any refund.
3.3 Cancellation by Lusso Safari Expeditions
We reserve the right to cancel or modify any safari due to unforeseen circumstances such as weather, safety concerns, or force majeure events. In this case, a full refund or alternative arrangements will be offered.
4. Amendments by Client
4.1 Modifications
Clients may request changes to their booking, including changes to dates, accommodation, or group size. Such changes are subject to availability and may incur additional fees.
4.2 Deadline for Amendments
Any requests for modifications must be submitted in writing at least 60 days before the departure date. Changes requested after this period may not be possible or may result in additional charges.
5. Amendments by Lusso Safari Expeditions
5.1 Itinerary Changes
In the event of unforeseen circumstances, Lusso Safari Expeditions reserves the right to alter the itinerary, accommodation, or other aspects of the safari to ensure the safety and enjoyment of all guests. We will do our best to provide suitable alternatives.
6. Travel Insurance
6.1 Insurance Requirement
We strongly recommend that all clients obtain comprehensive travel insurance to cover:
– Medical emergencies
– Trip cancellations or interruptions
– Lost or damaged luggage
– Personal liability
6.2 No Liability
Lusso Safari Expeditions is not responsible for any financial loss or inconvenience caused by clients failing to secure adequate travel insurance.
7. Liability and Responsibility
7.1 General Liability
Lusso Safari Expeditions will take all reasonable care to ensure the safety and comfort of our guests during the safari. However, we are not liable for:
– Any injury, loss, or damage to personal property during the trip.
– Delays or cancellations caused by third parties (e.g., airlines, hotels).
– Illness, accident, or personal injury during the safari.
7.2 Wildlife Encounters
Please note that wildlife sightings are not guaranteed, as they are subject to the natural behavior of animals.
8. Health and Medical Requirements
8.1 Health and Fitness
Clients must ensure that they are physically fit to participate in the safari activities, which may include hiking, long drives, and exposure to outdoor elements.
8.2 Medical Disclosure
Clients must inform Lusso Safari Expeditions of any pre-existing medical conditions or requirements that could affect their ability to participate in the safari.
8.3 Vaccinations and Health Precautions
It is the client’s responsibility to ensure they are up to date with any required vaccinations (e.g., yellow fever, malaria prophylaxis). Lusso Safari Expeditions is not responsible for any illness or health-related issues resulting from failure to comply with health regulations.
9. Force Majeure
9.1 Definition
Lusso Safari Expeditions is not responsible for any failure to fulfill obligations under these Terms and Conditions due to events beyond our control, including but not limited to:
– War
– Civil unrest
– Natural disasters
– Pandemics or epidemics
– Strikes or other labor disputes
In the event of a force majeure situation, we will do our best to offer alternatives or issue a partial refund, but we are not liable for any additional costs incurred by the client.
10. Governing Law and Jurisdiction
10.1 Governing Law
These Terms and Conditions are governed by the laws of Uganda. Any disputes arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Uganda.
11. Complaints and Dispute Resolution
11.1 During the Safari
If you have any issues during the safari, please inform a member of the Lusso Safari Expeditions team immediately so we can address the problem promptly.
11.2 Post-Safari Complaints
Any complaints must be submitted in writing to Lusso Safari Expeditions within 14 days of the completion of the safari. We will respond to all complaints in a timely manner and work to resolve any issues.
12. Use of Photos and Testimonials
12.1 Marketing Use
By booking with Lusso Safari Expeditions, you consent to us using photographs and testimonials taken during the safari for promotional and marketing purposes, unless you explicitly opt-out by notifying us in writing.
13. Child Policy
13.1 Children on Safari
We welcome children on our safaris; however, children must be accompanied by an adult at all times. Some safaris may have age restrictions or require additional accommodations, which will be noted at the time of booking.
13.2 Child Discounts
We offer discounts for children under 10years old, subject to the safari and accommodation type. Please inquire at the time of booking for specific pricing.
